US citizen found in possession of blade during incident

A US citizen was warned that if he was not found suitable for 240 hours of community service, then he was looking at six months in prison when he appeared before Galway District Court on public order charges.

Dara O’Toole, currently residing in support accommodation in Cork, was charged with the theft of goods valued at €40.35 from a Forster Street business on September 28, 2024. He was restrained by staff and he told them he had a knife in his pocket.

When Gardaí arrived and searched him they found a red Stanley knife in his possession. He was charged with having a blade on him as well as being drunk and engaging in threatening and abusive behaviour on the date.

The defendant was also charged with causing €300 in damage to the door of the Leonardo Hotel, Spanish Arch, and with being drunk and threatening and abusive to others on a separate occasion. He had 14 previous convictions.

Michael Cunningham solr (defending ) said his client was a US citizen, his father had a construction company there and there was work for him when he returned.

O’Toole is 27 and had engaged in a 12-week treatment programme and was receiving after-care. He had alcohol, drug and gambling issues but he had “kicked it all and was now doing very well.”

On the matter of the knife, the defence pleaded that his client worked as a cabinet-maker and used the Stanley knife for this. He added that he had €300 in Court as compensation for the damage to the hotel.

Judge Lydon asked Gardaí to check if the defendant had come to Garda attention since his treatment. She was informed that in March 2025 he had received a three-year suspended sentence at Limerick Circuit Court on a drug conviction and faced a drink driving charge, again in Limerick.

The Judge said she was reluctant to impose a suspended sentence as he was already serving one from Limerick and she considered him a high risk of reoffending.

She remanded O’Toole until the May 27 sitting to see if he was a suitable candidate for community service and, if so, she would consider 240 hours of community service instead of six months in prison.
