A young man was given a chance when he appeared before Judge Vincent Deane at Loughrea District Court charged with a shoplifting offence. This was the defendant’s second chance, as the Gardaí had offered him the option of accepting an adult caution, but he failed to turn up for the appointment to receive it and, as a result, the prosecution ended up before the court.
Julian Samu, 33 Fana Glas, Ballybane, Galway, entered Flanagan’s Pharmacy in Athenry, took aftershave to the value of €120 and left the shop without paying for it.
Gearoid Geraghty solr (defending ) pleaded that his client was spotted, stopped and the property was recovered. His client was 23, an Irish citizen and worked as a van driver. He pleaded for leniency as this was his first offence and he regretted his behaviour.
Judge Deane said he was taking into account that the defendant had no criminal record, pleaded guilty and had not been before the courts before, so he was going to give him a chance this time. He applied the Probation Act.
