Four year ban for man with a number of no insurance convictions

Judge Mary Devins banned a Ballyhaunis man from driving for four years after he was convicted for a third time for driving without insurance at Ballyhaunis District Court. Tommy Webb, Cornageachta, Aghamore who represented himself in court said that he had believed he was insured to drive the car he was stopped driving under a different insurance policy, but following investigations by the Gardai this proved not to be the case.

Garda Kenneth Waldron told the court that he stopped Webb on November 8 2012 at 1.15am in Ballyhaunis and saw that the NCT on the car had expired in March 2012 and the tax in September 2012. He went on to say that he demanded Webb produce his driving licence and insurance to a Garda station within 10 days and Webb produced his driving licence and an insurance certificate for a different vehicle to him on the morning of the court. Garda Waldron enquired with the insurance company about the policy and was told by them that it did not cover Webb to drive the car he was stopped in on the date in question.

In his own evidence Webb said that he thought that he was insured on it and on the night in question his child was sick and his other vehicle was in the garage and he was going to his parents’ house to get some Calpol.

Judge Mary Devins convicted and fined Webb €700 for driving without insurance and disqualified him from driving for four years. For non-display of insurance she convicted and fined him €50 and took other non-display charges into consideration.
