Man given Probation Act for being drunk in public

A man who, when drunk, interfered with the work of a doctor who was assisting an injured man, was given the benefit of the Probation Act at Ballina District Court.

The case, which was heard at a previous sitting, outlined that on August 29 2012 gardaí were called to the river bank in Crossmolina as a man had injured himself from a fall.

Patrick Murphy, Erris Road, Crossmolina was observed to be intoxicated at the scene and he also made threats at passers-by when he was asked to move from the scene.

The unemployed man, who has previous convictions, was remanded on continuing bail by Judge Mary Devins to this week’s court sitting.

Murphy has not come to garda attention since the incident and has also not drunk alcohol since August.

Judge Devins said that it was a “positive outcome...with Christmas coming up I give the benefit of section 11A”.
