Man kicked in head outside Supermac’s

A 20-year-old man who kicked a man who was lying on the ground in the head, was given the Probation Act at this week’s sitting of Ballina District Court after he was before the court for a disorderly conduct charge.

Sgt Regina Carley, who was on foot patrol on Pearse Street, Ballina, on August 2 2009 at 3.20am, observed a scuffle between a number of youths outside Supermac’s. The sergeant said that a “young man was fired onto the ground” and David Crane, 145 Greenhills Estate, Ballina, gave him a “forceful kick to the head”.

The defendant was pulled away from the man and Crane told the gardaí that “he hit me first”, which according to Sgt Carley was not the case. The man who was kicked had no injuries and did not make a complaint.

The unemployed man was directed by Judge Mary Devins to contribute €200 to the Garda Midwest Special Needs fund.
