Jail for man for theft of vodka and public order offences

A married man was sentenced to a total of eight months in prison for a number of public order offences and to a charge of theft in Claremorris District Court.

Ivoska Mindaugas, 59 Elm Park, Claremorris, pleaded guilty to the charges in court. Inspector Joe Doherty told the court that Mindaugas’ wife had also made a complaint of assault against him, but she wished to withdraw the complaint now. Judge Mary Devins told his wife: “You have cost the court time, the gardaí time, and you can go to jail for it. If you wish to live with a man who treats you as a punch bag it’s your choice.”

Garda John Cohen told the court that on March 3 2009, he was called to Tesco in Claremorris at 11am to a reported theft of a bottle of vodka. After reviewing the CCTV he identified the offender as Mindaugas and arrested him on a later date, the vodka was never recovered.

Garda Fiona Devaney told the court that on November 11 2009 she was called to an incident in Claremorris where she spoke to Mindaugas who said his wife was asleep on the footpath, when she spoke to his wife she told Garda Devaney that she had been beaten by her husband. Garda Devanney said she told Mindaugas to leave the area and he was drunk at the time, he did not leave the area, becoming abusive, and then he got involved in a boxing match with another man who was on the street. So she arrested him.

For the theft of the bottle of vodka Judge Mary Devins, convicted and fined him €100 and sentenced him to one month in prison. For threatening, abusive or insulting behaviour in a public place she convicted and fined him €500 and sentenced him to six months in prison concurrent. For failing to comply with the direction of a member of An Garda Síochána she convicted and fined him €200 and sentenced him to two months in prison to be served consecutively, and she took being intoxicated in a public place into consideration.
