Man needs help rather than fines — judge

Judge Mary Devins commented that bringing a Section Four Public Order Act charge (being intoxicated in a public place ) was meaningless as she was only able to impose a €120 fine, as she convicted a man whom she said needed help with his alcohol addictions.

John Fenwick, James Street, Claremorris, was convicted and fined €120 for an incident that occurred on June 26 2009. Garda Colin Murrin told the court that he found Fenwick at Claremorris GAA Pitch at 2.27am. Fenwick was in a highly intoxicated state and sitting on a wall. Fenwick then fell off the wall on to the ground before Garda Murrin arrested him and brought him to Claremorris Garda station. Fenwick pleaded guilty to the charge in court along with another charge from an incident when he was arrested for the same offence on July 1 2009 on Mount Street, Claremorris. Judge Devins took the second charge into consideration when sentencing him.
