Judge Mary Devins gave gardaí liberty to re-enter charges against a Brickens man who has failed to carry out the directions of the court after being convicted of animal cruelty.

Philip Breslin, a veterinary inspector with the Department of Agriculture told the court he was asked by gardaí to carry out an inspection on the lands owned by John Mulkeen, Crimlin, Brickens, Claremorris, Co Mayo, to ensure that he had carried out the directions of the court in reducing the numbers of sheep on his lands to 100 as ordered by the court following a previous conviction.

Breslin told the court that he inspected the lands in January and June 2008, the numbers were still more than 100 at those times as the court had allowed time to have the numbers reduced once the lambing season had concluded. Mr Breslin inspected the lands again on December 22 2008 at the behest of the gardaí and found there to be 280 sheep on the property. Judge Devins was also informed by Inspector Michael Foley that Mulkeen had not paid the fines that were imposed on him by the court in the past. Judge Devins set a date for hearing on March 3.
