Suspended sentence for man serving ninety-nine-year driving ban

A Claremorris man who is currently serving a 99-year driving ban imposed in 2004 was given a three-month sentence suspended for 12 months in Claremorris District Court this week.

Garda Donal Raftery told the court that at 8.47am on October 7 2010 he stopped a car being driven by David Fitzpatrick of Drumneen, Claremorris, Co Mayo at Mount Street, Claremorris. He ordered him to produce his driving licence and insurance at Garda station of his choice within 10 days. Only when Garda Raftery returned to the station did he learn that Fitzpatrick was serving a 99-year driving ban that had been imposed in Ballinrobe District Court in 2004.

The 33-year-old admitted in court that he was driving a car that he had bought and had no excuse for the action as he was aware that he was serving the driving ban imposed in 2004. For driving while disqualified Judge Mary Devins convicted and fined him €500 and sentenced him to three months in prison suspended for 12 months. She took driving with no insurance and no driving licence into consideration.
