Motorist fined for speeding in 50kmph zone

A driver of a Renault Megane which was detected driving in excess of the speed limit in a 50km zone was convicted and fined at Foxford District Court this week.

Garda Pat O’Hora, while operating a speed check on April 26 2008 at 9.20pm saw Lee Cunningham, Kilgaellia, Attymass, Foxford driving at 90km in a 50km zone. A fixed charge notice was issued by Gda O’Hora, however the charge was never paid.

Cunningham, who represented himself, said that he posted in the fine, but had no proof that he did this. The defendant also told the court that when he was detected on a previous occasion he paid the money; so why would he not have not paid on this occasion?

Judge Mary Devins asked Cunnigham why he was speeding to which she was told that his daughter was in hospital and he was in a panic.

Judge Devins convicted and fined the defendant €200 but added that “some of my colleagues would disqualify you for speeding” and said that if there is another detection for speeding then she will disqualify Cunningham.
