Probation Act applied in assault case

A woman in her 20s who pulled the hair and scraped the face of another woman, in an unprovoked attack outside a Ballina takeaway, was given the benefit of the Probation Act at Ballina District Court.

In the early hours of New Year’s Day 2011 Klara McGoldrick, 95 Convent Hill Avenue, Ballina (now residing at 13 Oakwood Drive, Ballina ), for no reason assaulted Lisa Carr outside Supermac’s as Ms Carr sat eating food with friends. Gardaí on foot patrol intervened in the incident.

The court heard that McGoldrick has previous convictions. Judge Mary Devins adjourned the matter. At this week’s Ballina District Court a probation report was handed in to the judge. Compensation has been paid and McGoldrick is now off alcohol and drugs.

Judge Devins said that the defendant has “made great efforts” and “that should be recognised”. The Probation Act was applied and the judge said to McGoldrick that she wished her luck.
